The Department of State Freezes Immigrant Visas from 75 Countries
What it means for H-2A employers

The U.S. Department of State has indefinitely paused immigrant visa processing for applicants from 75 countries, including Guatemala, Brazil, and Thailand, effective January 21. The pause applies only to consular-processed immigrant visas (green cards) and is tied to a reassessment of screening procedures related to the “public charge” ground of inadmissibility, which concerns applicants deemed likely to become financially dependent on U.S. government assistance. The suspension does not affect nonimmigrant visa categories, including H-2A, H-2B, or tourist visas, and nonimmigrant visa processing continues as normal through Seso.
